1Про ці умови

Ці Умови регулюють використання мобільного застосунку Tutorio для iOS та Android і сайту tutorio.pro (разом — «Сервіс»). Сервіс надає фізична особа — розробник Tutorio («ми»). Створюючи акаунт або користуючись Сервісом, ви погоджуєтеся з цими Умовами та з Політикою конфіденційності. Якщо ви не погоджуєтеся, не користуйтеся Сервісом.

2Хто може користуватися

• особи віком від 18 років, які можуть укладати договори;
• для власної репетиторської чи викладацької діяльності;
• з правдивими даними акаунта. Один акаунт — одна людина; не передавайте акаунт іншим.

3Що робить Tutorio

Tutorio допомагає вести розклад, учнів і групи, відмічати присутність, рахувати передоплати, борги й дохід.

Tutorio не є платіжним сервісом. Він не приймає, не зберігає й не переказує гроші та не видає чеків — суми в застосунку є лише вашими записами. Tutorio не надає бухгалтерських, податкових чи юридичних консультацій. Розрахунки, як-от списання за пропущені заняття, виконуються за правилами, які налаштовуєте ви, тому перевіряйте результат. Ви самостійно відповідаєте за свої податкові та інші обов'язки.

4Акаунт і безпека

Увійти можна через email і пароль, Google або Apple. Бережіть пароль і доступ до пристрою: ви відповідаєте за дії, виконані у вашому акаунті. Якщо підозрюєте несанкціонований доступ, змініть пароль і напишіть нам.

5Ваші дані й дані учнів

Усе, що ви вносите в Tutorio, належить вам. Ви надаєте нам невиключне безоплатне право зберігати й обробляти ці дані лише в обсязі, потрібному для роботи Сервісу.

Вносячи дані учнів — контакти, фото, дати народження, нотатки, — ви підтверджуєте, що маєте на це законну підставу, зокрема згоду учня або, якщо учень неповнолітній, згоду його батьків чи законних представників. Не вносьте зайвого, зокрема чутливих даних про здоров'я, якщо в цьому немає потреби.

6Що заборонено

• порушувати закон або права інших людей;
• втручатися в роботу Сервісу, обходити обмеження, перевантажувати його чи шукати вразливості без нашого дозволу;
• декомпілювати чи модифікувати застосунок, крім випадків, прямо дозволених законом;
• автоматично збирати дані з Сервісу;
• завантажувати незаконний чи образливий контент або шкідливий код;
• видавати себе за іншу людину.

7Вартість

Зараз Tutorio безкоштовний. Якщо з'являться платні функції, ми заздалегідь покажемо ціну й умови, а плата стягуватиметься лише з вашої явної згоди — через App Store або Google Play за їхніми правилами.

8Доступність і зміни Сервісу

Сервіс надається «як є» та «як доступно». Ми можемо змінювати, додавати чи прибирати функції й проводити технічні роботи та не гарантуємо безперервної роботи без помилок.

Частина даних зберігається лише на пристрої й зникає після виходу з акаунта або втрати телефона. Для важливих записів ведіть власні копії.

9Відповідальність

У межах, дозволених законом, ми не відповідаємо за непрямі збитки, втрачений дохід, помилки у ваших записах чи втрату даних з причин, які від нас не залежать, — наприклад, через збій або втрату пристрою чи дії третіх осіб. Ніщо в цих Умовах не обмежує прав, яких вас не можна позбавити за законом, зокрема прав споживача.

10Припинення

Ви можете будь-коли видалити акаунт у застосунку (Профіль → Видалити акаунт) — дані видаляються одразу. Ми можемо обмежити чи припинити ваш доступ, якщо ви порушуєте ці Умови або закон, чи якщо цього вимагає закон.

11Інтелектуальна власність

Застосунок, сайт, назва Tutorio, логотип і дизайн належать розробнику. Ми надаємо вам особисту, невиключну, непередавану ліцензію, яку можна відкликати, користуватися застосунком на ваших пристроях відповідно до цих Умов і правил магазину застосунків. Apple і Google не є сторонами цих Умов і не відповідають за Сервіс чи його підтримку.

12Зміни умов

Ми можемо оновлювати ці Умови. Дата вгорі сторінки показує чинну редакцію. Про суттєві зміни ми повідомимо в застосунку або листом заздалегідь. Якщо ви продовжуєте користуватися Сервісом після набрання змінами чинності, ви погоджуєтеся з ними.

13Застосовне право і спори

До цих Умов застосовується законодавство України. Спершу напишіть нам — більшість питань вирішуються листуванням. Якщо дійти згоди не вдалося, спір розглядається судами України. Якщо ви споживач в іншій країні, за вами зберігаються обов'язкові права, які надає її законодавство.

These Terms govern your use of the Tutorio mobile app for iOS and Android and the website tutorio.pro (the “Service”). The Service is provided by a private individual, the developer of Tutorio (“we”). By creating an account or using the Service you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.

2Who may use it

• people aged 18 or older who can enter into contracts;
• for their own tutoring or teaching work;
• with truthful account details. One account per person; do not hand your account to anyone else.

3What Tutorio does

Tutorio helps you keep a schedule, students and groups, mark attendance, and track prepaid balances, debts and income.

Tutorio is not a payment service. It does not take, hold or transfer money and does not issue receipts — amounts in the app are your records only. Tutorio does not give accounting, tax or legal advice. Calculations such as charges for missed lessons follow the rules you configure, so check the results. You are responsible for your own tax and other obligations.

4Your account and security

You can sign in with an email and password, Google or Apple. Keep your password and your device safe: you are responsible for what happens in your account. If you suspect unauthorised access, change your password and write to us.

5Your data and your students' data

Everything you enter in Tutorio belongs to you. You grant us a non-exclusive, royalty-free right to store and process it only as far as needed to run the Service.

By entering students' data — contacts, photos, dates of birth, notes — you confirm that you have a lawful basis for it, in particular the student's consent or, for a minor, the consent of their parents or legal guardians. Do not enter more than you need, especially sensitive health information.

6What is not allowed

• breaking the law or other people's rights;
• interfering with the Service, bypassing its limits, overloading it or probing it for vulnerabilities without our permission;
• decompiling or modifying the app, except where the law expressly allows it;
• scraping data from the Service by automated means;
• uploading illegal or abusive content or malicious code;
• impersonating anyone else.

7Price

Tutorio is currently free. If paid features ever appear, we will show the price and terms in advance, and you will be charged only with your explicit consent — through the App Store or Google Play under their rules.

8Availability and changes

The Service is provided “as is” and “as available”. We may change, add or remove features and carry out maintenance, and we do not guarantee uninterrupted or error-free operation.

Some data is kept only on your device and is gone after you sign out or lose the phone. Keep your own copies of records that matter.

9Liability

To the extent the law allows, we are not liable for indirect losses, lost income, mistakes in your records, or data loss caused by things outside our control — such as a failed or lost device or the actions of third parties. Nothing in these Terms limits rights that the law does not allow to be taken away, including consumer rights.

10Ending your use

You can delete your account at any time in the app (Profile → Delete account); the data is deleted immediately. We may restrict or end your access if you breach these Terms or the law, or if the law requires it.

11Intellectual property

The app, the website, the Tutorio name, logo and design belong to the developer. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on your devices under these Terms and the rules of your app store. Apple and Google are not parties to these Terms and are not responsible for the Service or its support.

12Changes to these terms

We may update these Terms. The date at the top shows the version in force. We will announce significant changes in the app or by email in advance. Continuing to use the Service after changes take effect means you accept them.

13Governing law and disputes

These Terms are governed by the laws of Ukraine. Please write to us first — most issues are settled by email. If we cannot agree, the dispute goes to the courts of Ukraine. If you are a consumer in another country, you keep the mandatory rights its laws give you.
